How much does it cost to file for adoption in Oklahoma?
Filing an adoption in Oklahoma costs $158 — a $105 flat fee plus $53 of statutory assessments, all set in one statute. Title 28, §152(A)(8) of the Oklahoma Statutes prices adoption at a $105 flat fee, collected by the district court clerk at the time of filing. The assessment subsections then attach to adoption expressly: subsection (B) adds $6 for the Law Library Fund on paragraphs including (A)(8); subsection (C) adds $25 for the Oklahoma Court Information System; subsection (D) adds $10 for Oklahoma court-appointed special advocates; subsection (E) adds $2; and subsection (G) adds $10. This is the same §152 arithmetic this site's Oklahoma probate costs, Oklahoma divorce costs and Oklahoma custody costs pages work through for their own paragraphs — adoption simply starts from a lower flat fee than any of them.
Oklahoma adoption fees at a glance
| Item | Cost |
|---|---|
| Adoption flat fee (28 O.S. §152(A)(8)) | $105 |
| Law Library Fund assessment, subsection (B) | $6 |
| Oklahoma Court Information System assessment, subsection (C) | $25 |
| Court-appointed special advocates assessment, subsection (D) | $10 |
| Judicial complaints and interpreter assessment, subsection (E) | $2 |
| Assessment under subsection (G) | $10 |
| Total clerk charges to file an adoption | $158 |
Two features of §152 frame the total honestly. First, the flat fees are declared to be the only charge for court costs except as otherwise specifically provided by law, and none of them is ever refundable — so $158 is a ceiling for the clerk's opening charges, not a deposit against later billing. Second, one further assessment is deliberately excluded from the table: subsection (F) lets each county, on approval of its board of county commissioners, assess up to $10 per case for courthouse security on paragraphs including (A)(8). Because that charge is optional and county-by-county, a filer in an adopting county pays up to $168 while a filer elsewhere pays $158 — the clerk confirms which applies. Even at its maximum, Oklahoma's adoption filing remains among the cheapest in the country, a consequence of the flat-fee design: adoption at $105 sits below probate and guardianship at $135 and well below divorce and custody at $183 in the same subsection. What kind of adoption, and what else the court requires
Oklahoma adoptions proceed under the Oklahoma Adoption Code, Title 10, chapter 75, in district court. The §152(A)(8) price does not vary by adoption type — stepparent, relative, agency and independent adoptions all open at the same flat fee, because the statute prices the filing, not the family's shape. What varies is the surrounding machinery: home studies where the Code requires them, background checks for petitioners, consents or terminations of parental rights, and the final hearing at which the decree is entered. A contested termination folded into an adoption can turn a simple filing into litigation, but it does not change the opening clerk charge; later filings inside the case are governed by §152's other paragraphs and the clerk's uniform schedule, including the (A)(14) $85 catch-all for actions the schedule does not name. The Uniform Oklahoma Fee Schedule issued by the Supreme Court's Administrative Office of the Courts confirms the adoption line at $105 under §152(A)(8) in its civil filing fees table.
How the case runs
- Complete the adoption petition and the Adoption Code paperwork for the district court of the proper county
- File the petition and pay the clerk charges $158
- Complete required background checks and any home study through the provider handling them
- Address consents or, where necessary, termination of parental rights
- Attend the final hearing, receive the decree of adoption, and order certified copies for records and the amended birth certificate
Filing fee + service + publication + certified copies is the real number. Stack all four for your state and procedure in the calculator.

The $158 is the court door, not the adoption. Agency fees, where an agency places the child, are set by the agency; home study charges are set by the study provider; background check charges are set by the agencies that run them; and attorney fees — commonly engaged for the petition, the consent or termination work and the final hearing — are market-priced. None of those figures appears in §152 or on a statewide schedule, so this page names them without inventing amounts, the same discipline applied on this site's Washington adoption costs, California adoption costs and Oregon adoption costs pages. Stepparent adoptions are typically the leanest because the child already lives in the petitioner's home and parts of the study machinery may be waived by the court; independent adoptions carry the most provider-side cost. Can't afford the fee?
Section 152(H) builds the relief into the same statute: a litigant who, by reason of poverty, cannot pay the fees and costs and cannot employ counsel may file an affidavit in forma pauperis, and on a satisfactory showing that the litigant has no means to pay, no fees or costs shall be required. The affidavit is sworn before an officer authorised to administer oaths and should be filed with the petition, so the clerk can open the case under the order rather than holding it for payment. A granted application reaches the clerk's charges; agency, study and provider costs are separate questions for the providers and, where applicable, the court. The general mechanics of fee waivers are explained in the fee waiver guide.
