How much does a name change cost in Oklahoma?

Changing your legal name in Oklahoma costs an $85 flat filing fee, $138 with the statutory assessments. Oklahoma's name change procedure sits in Title 12, §§1631 and following, and the petition is filed in district court — but §152's flat fee schedule has no name-change-specific line, so the petition takes the schedule's catch-all: 28 O.S. §152(A)(14) prices "all others" at $85, the same paragraph that names forcible entry and detainer and judgments from other courts. The five assessments in subsections (B) through (G) add $53 on a paragraph (14) filing — $6 Law Library Fund, $25 Oklahoma Court Information System, $10 court-appointed special advocates, $2 judicial complaints and interpreters, and $10 records preservation — for a state total of $138 before publication.

The catch-all reading deserves to be shown rather than assumed, because it is the whole basis of the price. Section 152(A) lists fifteen case types with their own flat fees — divorce and custody at $183, probate and guardianship at $135, adoption at $105, money actions at $150 or $163 by amount — and then paragraph (14) sweeps up everything else at $85, "including but not limited to" the examples it names. A name change petition is not any of the fourteen specific lines, so it is an "all others" filing, and the Supreme Court's Uniform Oklahoma Fee Schedule groups filings the same way. Paragraph (14) is expressly listed in subsection (B)'s law library assessment and in subsection (F)'s optional county courthouse security assessment of up to $10 — excluded from the $138 here — so a county that has adopted the security assessment collects up to $148. One further clerk charge belongs to this procedure specifically: §152.1 prices the posting of notices and filing of certificates required by statute at $30, and a name change is a posting-and-publication procedure, so petitioners should expect that line at the counter as well. Publication: the step that defines the procedure

Title 12's name change chapter builds the case around public notice. The verified petition states the petitioner's name, the name sought, and the reasons for the change, and notice of the filing and hearing is published in a newspaper authorised to run legal notices in the county — the proof of that publication, with the clerk's posting and certificates, is what the §152.1 $30 line pays for. The newspaper's own publication charge is set by the paper within the legal-notice rates Oklahoma law allows, and it varies with the length of the notice, so this page names it without inventing a figure. The hearing itself is ordinarily short: the court must be satisfied the change is not sought for a fraudulent or wrongful purpose, and the decree then changes the name for all purposes. Certified copies of the decree — priced under the clerk's general copy charges rather than §152 — are what Social Security, the driver's licence office, passport services and banks will ask for afterwards. The same $85-plus-$53 structure prices the eviction filing on this site's Oklahoma eviction costs page, because both procedures live in paragraph (14).

How the case runs

  1. Prepare the verified petition under 12 O.S. §§1631 and following, stating the current name, the name sought and the reasons
  2. File the petition in district court and pay the flat fee and assessments $138, plus the posting charge where collected $30
  3. Publish notice of the petition and hearing in a county legal newspaper — the newspaper sets that charge — and file the proof of publication
  4. Attend the hearing; if the court finds no fraudulent or wrongful purpose, it signs the decree of name change
  5. Order certified copies of the decree and update Social Security, identification, passport, bank and payroll records

What a name change really costs beyond the clerk

Beyond the counter total, an Oklahoma name change costs the newspaper's publication charge and the price of the new documents that follow the decree — replacement licence, passport and, where wanted, an amended birth certificate through Vital Records — plus an attorney's private rate if one prepares the petition. None of those amounts is fixed by §152 or §152.1, so this page names them without inventing figures, the same discipline applied on this site's Maryland name change costs and North Carolina name change costs pages. What a petitioner can predict from the statutes is the court-side spine: $85 flat, $53 in assessments, $138 collected, a $30 posting line, and up to $10 more in counties that have adopted the security assessment. The wider state picture is on the Oklahoma court costs guide.

Can't afford the fee?

Section 152(H) lets a litigant who has a just cause of action but, by reason of poverty, cannot pay the fees and costs and cannot employ counsel file an affidavit in forma pauperis; on a satisfactory showing of no means, no fees or costs are required. The showing is made to the court on the sworn affidavit. A waiver reaches the court-side charges in §§152 and 152.1; it does not pay the newspaper, so a petitioner who needs both forms of relief should ask the court about publication as well. The general mechanics of fee waivers are explained in the fee waiver guide.
