How much does it cost to file for custody in Virginia?

Starting a custody or visitation case in Virginia costs a $25 filing fee — one of the lowest custody filing fees in the country. Virginia Code §16.1-69.48:5 sets that fee for the initial commencement of a case in the juvenile and domestic relations district court (J&DR court) where custody or visitation is in controversy, and the statute adds two protections filers rarely get elsewhere: only one $25 fee is required for all custody and visitation petitions filed simultaneously by a single petitioner, and no other fees or costs may be added to that fee as a condition of filing. A parent filing for custody of two children at the same time therefore pays $25 once, not $25 per child and not $25 per petition.

Virginia custody fees at a glance

ItemCost
Initial custody or visitation filing fee, J&DR court (§16.1-69.48:5)$25
Multiple custody and visitation petitions filed simultaneously by one petitioner$25 total
Other fees added as a condition of filingNone — barred by statute
Sheriff service of process on the respondent (§17.1-272)$12
Reissuance of process once, within three months of the original return dayNo charge
Case brought by an agent of the Commonwealth or a local government entityNo fee

The $25 figure is a statute, not a county schedule, so it does not change from Fairfax to Roanoke to Virginia Beach: every J&DR clerk in the Commonwealth collects the same fee for the same petition. That uniformity is unusual in Virginia, where circuit court civil fees are quoted through a fee calculator because they are built from several components. Custody starting in J&DR court is deliberately simpler — the General Assembly fixed a single low fee, forbade add-ons as a filing condition, and provided that the case cannot be set for hearing until the fee is paid, except where the filer proceeds on account of poverty under §17.1-606. The national picture is on the child custody filing costs hub and the wider state picture is on the Virginia court costs guide.

Why custody starts in J&DR court

Virginia gives its juvenile and domestic relations district courts original jurisdiction over custody and visitation disputes involving a child, under §16.1-241(A)(3) — the subdivision §16.1-69.48:5 cross-references for its fee. A parent who is not filing as part of a pending divorce normally starts in the J&DR court of the city or county where the child lives. Custody raised inside a divorce case, by contrast, is heard in circuit court as part of that divorce, and the divorce filing fee — not the $25 J&DR fee — is the price of opening that case; this site's Virginia divorce costs page covers that route. Knowing which door you are walking through matters more to the price than anything in the petition itself: the same custody dispute costs $25 to open on its own in J&DR court and is bundled into a much larger circuit court filing when it rides with a divorce.

Service: the $12 line most filers also pay

The filing fee opens the case, but the other parent must be served before the court can hear it. Virginia Code §17.1-272 prices process and service generally: service on a person of an order, notice, summons or other civil process costs $12 when performed by a sheriff. The custody statute adds a small mercy on failed service: once a petition on which the $25 fee has been paid has been served — or service has been attempted — the petition may be reissued once by changing the return day, with no charge for that reissuance, provided it happens within three months after the original return day. Private process servers also work in Virginia and set their own rates; this page does not price them, because no official schedule does. A realistic clerk-and-sheriff opening total for a straightforward one-respondent case is therefore $25 plus $12, or $37, before any optional extras.

How the case runs

  1. Confirm the child lives in the city or county whose J&DR court you plan to file in
  2. Complete the custody or visitation petition from the J&DR clerk
  3. File the petition and pay the filing fee $25
  4. Have the respondent served — sheriff service is priced by statute $12
  5. Attend the first hearing; the court may order mediation, a custody evaluation or further hearings depending on the dispute

What custody really costs beyond the clerk

The $25 fee is genuinely the whole price of admission, because the statute forbids piling other charges onto it as a filing condition — but it is not the whole cost of a custody fight. Mediation, where the court orders it or the parents choose it, is priced by the mediator. Custody evaluations and guardian ad litem appointments, where a judge orders them, carry their own court-set or provider-set charges, and no statewide schedule publishes them, so this page does not invent figures for them. Attorney fees are market-priced and are normally the largest cost in a contested case. Appeals matter too: a J&DR custody decision can be appealed to circuit court for a new hearing, and on an appeal under §16.1-296 the J&DR clerk collects the applicable circuit court service fees from the appellant before transmitting the case — the appeal itself is a fresh proceeding with its own costs, even though the original filing was $25. Can't afford the fee?

Section 16.1-69.48:5 itself builds in the exception: a case subject to the fee can be set for hearing without prepayment on account of poverty as provided in §17.1-606, Virginia's in forma pauperis statute for district courts. In practice the filer asks the J&DR clerk for the poverty affidavit at the same visit as the petition, completes a sworn statement of income, assets and expenses, and the court decides whether the $25 must be paid before the case moves. Given how small the fee is, the waiver matters most where service and other costs stack up — but the right to ask is statutory, not discretionary charity. The general mechanics of fee waivers are explained in the fee waiver guide.
