How much does it cost to file for adoption in Minnesota?
Filing an adoption petition in Minnesota costs $397 for a child born in the United States in the state's largest county — and $322 where the registry surcharge does not apply. The Hennepin County District Court fee schedule, published by the Minnesota Judicial Branch with changes effective July 1, 2025, prices a Petition for Adoption at $397 (child born in the U.S.), $322 (child born outside the U.S.) and $322 (adult adoptee) on its Juvenile Court list. The arithmetic is statutory: the $322 county total for a first filing under Minn. Stat. §357.021, plus the $75 fathers' adoption registry surcharge that §357.021, subdivision 2, clause (15) adds to each adoption petition under §259.52, subdivision 14.

Minnesota adoption petitions are heard in district court sitting as juvenile court, which is why the adoption lines sit on the schedule's Juvenile Court list rather than the Family Court list that carries Minnesota custody costs. The $75 difference between the two adoption prices is not a county invention: clause (15) of §357.021 requires a $75 surcharge on each adoption petition filed in district court to fund the fathers' adoption registry under §259.52, the registry a putative father uses to preserve notice rights in an adoption. The Hennepin schedule applies that surcharge where the registry is engaged — a child born in the United States — and prices the petition at the plain $322 filing total for a child born abroad and for an adult adoptee. The base underneath both prices is the same first-paper structure described on this site's Minnesota probate costs page: a $310 statutory fee under clause (1), collected at $322 in Hennepin County once the county law library fee is included. The national comparison is on the adoption filing costs hub.
What else the juvenile counter charges
An adoption rarely travels alone through the juvenile division, and the neighbouring lines matter to families whose cases arrive in stages. A petition for dependency, neglect or termination of parental rights — the proceeding that can precede an adoption when parental rights must be ended first — is priced at $322 on the same list, as is a motion to intervene as a party. Ordinary motions and responses in juvenile court are $100, matching clause (4) of the statute for motions in civil, family and guardianship cases. Certified copies of the adoption decree — the document schools, passport offices and vital-records clerks will ask for — are $14 each under clause (2), and the schedule prices exemplified copies at the same $14. One statutory exemption belongs here rather than in the fine print: subdivision 1a, paragraph (c) of §357.021 requires no fee from the public authority in the child-protection chapters it lists, so a county-driven dependency case is not charged like a private adoption petition.
How the case runs
- Complete the pre-petition steps the adoption chapter requires — consents or a termination of parental rights, and the background and home-study work arranged outside the court
- File the petition for adoption in district court, juvenile division, and pay the petition fee $397 U.S.-born / $322 other
- Give the notices the adoption chapter requires, including the registry process the $75 surcharge funds
- Work inside the case at motion prices if disputes arise $100
- Attend the adoption hearing and receive the final decree; order certified copies for records $14 each
Filing fee + service + publication + certified copies is the real number. Stack all four for your state and procedure in the calculator.

The court's $397 is the smallest predictable piece of most Minnesota adoptions. Home studies, agency services where an agency is involved, attorney fees for the petitioners and for any contested consent or termination, and the cost of amending a birth record with the Minnesota Department of Health are all priced by the provider or agency that supplies them — none appears on the Judicial Branch fee schedule, so this page names them without inventing figures, the same discipline applied on this site's Washington adoption costs and Oklahoma adoption costs pages. Stepparent and adult adoptions, which usually need no agency or home study, are the cases where the court-side spine is close to the whole cost: $397 or $322 to file, $100 motions, $14 certified copies of the decree. The wider state picture is on the Minnesota court costs guide.
Can't afford the fee?
Minnesota district courts can reduce or waive court fees for petitioners who cannot afford them through the in forma pauperis process under Minn. Stat. §563.01, on a sworn statement of income, assets and expenses filed with the petition. A waiver covers court fees; it does not reach the outside costs above, which belong to agencies and providers. Ask court administration about the waiver forms before the petition is filed, and confirm whether the $75 registry surcharge is treated as part of the waived filing fee in your county. The general mechanics of fee waivers are explained in the fee waiver guide.
